Welcome to Outsmart Notes. By accessing or using our website, web application, and related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

1. Description of Service

Outsmart Notes provides a free, high-performance, browser-based notepad with local note management, real-time text transformation utilities, multi-format export tools (PDF, DOCX, TXT, JSON, CSV, QR Code), and client-side zero-knowledge encrypted note sharing.

2. 100% User Ownership of Content

You retain full, unencumbered ownership and copyright of all notes, text, code snippets, and data you type or paste into Outsmart Notes.

We claim no intellectual property rights or ownership over your content. Because Outsmart Notes operates primarily on client-side storage, your content belongs entirely to you and remains under your exclusive control.

3. Acceptable Use Policy

You agree to use Outsmart Notes only for lawful purposes. You specifically agree not to use the encrypted sharing service to:

  • Transmit, share, or store any content that is illegal, defamatory, harassing, or infringing upon third-party intellectual property rights.
  • Distribute malicious software, computer viruses, Trojan horses, worms, or phishing links.
  • Attempt to interfere with, disrupt, or compromise the integrity or security of our web servers or network infrastructure.
  • Engage in automated scraping or denial-of-service activities against our public API endpoints.

We reserve the right to remove any shared encrypted ciphertext or block access to the service in cases of system abuse or legitimate legal process.

4. Data Backup Responsibility

While Outsmart Notes uses robust browser storage (IndexedDB) with automatic persistence, web browsers may clear local cache or storage under extreme low-disk-space conditions or if the user explicitly clears browser browsing data. Users are strongly encouraged to use the built-in "Backup All" feature to maintain offline backups of critical documents. Outsmart Notes is not responsible for data loss resulting from browser cache clearing, device failure, or hardware malfunction.

5. Disclaimer of Warranties

Outsmart Notes is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free from vulnerabilities.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Outsmart Notes, its founders, engineers, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of, or inability to use, this service or any loss of data.

7. Modifications to Terms

We reserve the right to modify or update these Terms of Service at any time. Material changes will be indicated with an updated "Last Updated" date at the top of this page. Your continued use of the service following any revisions constitutes your acceptance of the new terms.
